Frequently asked questions
In Mexico, trademarks, slogans (avisos comerciales), and trade names are registered before the IMPI. Before filing, it is advisable to confirm that the proposed mark is available and to define the goods or services it will cover. Once granted, the registration requires renewals and declarations of use to remain in force. We will be glad to review your case in a consultation and explain the steps to follow.
When a third party uses a registered trademark without authorization or reproduces a protected invention or work, Mexican law provides for infringement proceedings before the IMPI, as well as unfair competition actions. The appropriate avenue depends on the type of right, the available evidence, and the scope of the unauthorized use.
