Labor Law

Employer compliance and risk prevention in your labor relations

Message us on WhatsApp

The Labor practice of R&A Asociados focuses on preventive, contractual, and employer compliance advice. Our goal is for the employment relationships within your company to be conducted in accordance with the Ley Federal del Trabajo (Federal Labor Law, LFT) and other applicable regulations, from hiring to termination, with proper documentation and legally sound decisions at every stage.

Our practice is focused on preventing labor risks and contingencies; for this reason, we do not handle litigation in this area. Instead, we provide comprehensive support for the internal management of human resources: contracts, policies, calculation of benefits, compliance with the requirements of the IMSS (Mexican Social Security Institute), INFONAVIT (National Workers' Housing Fund Institute), SAR (Retirement Savings System), and STPS (Ministry of Labor and Social Welfare), conciliation, and training. We do so from a strategic legal perspective, aimed at anticipating problems before they become disputes.

Our labor practice is preventive and focused on employer compliance. We do not litigate in this area; we support internal human resources management and labor conciliation proceedings.

Frequently asked questions

Common questions about this practice area.

Does R&A Asociados handle labor lawsuits?

No. Our labor practice is preventive and focused on employer compliance: contracts, internal policies, calculation of benefits, compliance with IMSS, INFONAVIT, SAR, and STPS requirements, conciliation, and training. We do not represent companies or employees in proceedings before labor courts. The aim is to reduce the risk of a dispute arising and, if one does arise, to seek a solution through conciliation. If you would like to review your company's situation, we would be pleased to schedule a consultation.

What should I consider before terminating an employee?

The termination of an employment relationship must comply with the LFT as to the grounds, the form, and the calculation of the final pay settlement (finiquito) or severance package (liquidación). A poorly documented decision can turn into a contingency. The firm advises on the procedure, calculates the benefits, and designs strategies to mitigate risks. Every case is different, so we recommend that you schedule a consultation before taking action.

Can you help if my company is undergoing a review by the IMSS, INFONAVIT, or STPS?

Yes. We advise companies during labor reviews and audits by the competent authorities, verify that contracts, notices, and general working conditions comply with STPS requirements, and review employer and employee social security contributions to the IMSS, INFONAVIT, and SAR. We also conduct preventive audits to correct non-compliance before an inspection. If your company is in this situation, please schedule a consultation so that we can review it.

These answers are for guidance only; each case requires individual analysis.
