SAT carta invitación (invitation letter): what it is, what to review, and how to respond on time

A carta invitación does not open an audit, but it should not go unread either: it flags discrepancies the SAT (Tax Administration Service, Mexico's federal tax authority) has already detected. What it means, how to confirm it is genuine, and what to do in the days that follow.

An alert in the Buzón Tributario (the SAT's electronic tax mailbox) and, once opened, a letter pointing out discrepancies between what you reported and what the SAT has in its databases. It tends to provoke two costly reactions: paying without reviewing, as if it were an audit, or leaving it unopened. Knowing what it is, which deadlines run, and what the Supreme Court has said makes a measured response possible.

The essentials, in thirty seconds

  1. The carta invitación is an assistance and oversight communication (Article 33, Section IV, of the CFF) whose delivery is not deemed to initiate an audit; audit powers begin with the first act served under Article 42.
  2. It may arrive via the Buzón Tributario, by email, or at your address. Through the Buzón, you have three business days from the day after the alert to open it; if unopened, it is deemed served on the fourth day (CFF, Arts. 17-K and 134).
  3. Verify it by going directly to the SAT portal, never via links in the message, and using its verification tools; the SAT does not ask for passwords by email or phone, and all payments are made with a línea de captura (payment reference).
  4. The Second Chamber of the SCJN (Mexico's Supreme Court) has held that the carta invitación is not a final ruling open to challenge: it is a declaratory act urging correction (binding precedents 2a./J. 62/2013 and 2a./J. 110/2019).
  5. You have three paths: clarify the matter with the SAT, self-correct by filing an amended return, or document why the discrepancy does not apply. In every case, keep the filing receipts.

What it is and what it is not

The Código Fiscal de la Federación (Federal Tax Code, CFF) provides for it in Article 33. Section IV directs the authorities to promote compliance by sending payment proposals, prefilled returns, and communications about detected inconsistencies or atypical behavior, and specifies that such delivery is not deemed to initiate an audit (the exercise of audit powers, or facultades de comprobación). Section I, subsection (b), adds the invitation to visit the authority's offices for guidance on correcting one's tax situation. The SAT's oversight programs feed these letters.

NoteDeep oversight (vigilancia profunda)

A SAT program to correct inconsistencies between what was reported and its databases. The invitation letter (oficio invitación) may summon the taxpayer to an interview, in person or online, or request clarifications through an institutional email address; in either case the SAT grants ten business days to correct or clarify.

What the letter is not: an audit act. Audit powers are set out in Article 42 (requesting accounting records, conducting on-site audits, reviewing statutory tax audit reports) and begin with the first act served on the taxpayer. The desk audit under Article 48 opens with a request for documents and leads to a letter of findings (oficio de observaciones), with twenty days to rebut it. The letter opens none of those channels.

Three documents that should not be confused
DocumentLegal basis (CFF)Deadline set by law
Carta invitaciónArt. 33, Secs. I, subsection (b), and IVNone; whatever the letter states
Formal request for omitted obligations (requerimiento)Art. 41, Sec. IFifteen days to comply, with a fine
Desk audit (revisión de gabinete)Arts. 42 and 48Twenty days against the letter of findings

Why it should not be ignored

Not being an audit does not mean it has no effect: according to the Second Chamber, the letter reports an amount recorded in the authority's files, which the authority will take into account if it later exercises its audit powers over that period. If it is served through the Buzón Tributario, moreover, Article 17-K requires you to check the mailbox within three days of the electronic alert and, under Article 134, if the document is not opened within that period, service is deemed made on the fourth day.

It is merely a declaratory act, through which the authority urges the taxpayer to correct its tax situation regarding the omissions detected, presenting a payment proposal that causes no actual harm to the taxpayer's legal sphere.

How to confirm that it is genuine

Letters may arrive through the Buzón Tributario, which Article 17-K assigns to every person with an RFC (Mexican taxpayer ID number), but also by email or at your address, channels the SAT mentions for letters on the collection of tax debts. Whatever the channel, do not use the links or phone numbers in the message: log in to the SAT portal with your password or e.firma (SAT advanced electronic signature) and check the letter there.

  • If it concerns tax debts, it must bear an invitation number (the SAT states that all Cobro Persuasivo, or voluntary collection, letters carry one), which you can validate on its Adeudos fiscales (tax debts) page, Consulta tab.
  • If it is electronically signed, the SAT allows you to verify its integrity and authorship with the folio number, your RFC, and the last eight characters of the signature, or with the document's QR code (Articles 17-I and 38 of the CFF).
  • The SAT does not request information or passwords by email or phone, identifies itself clearly, and every payment is made with a línea de captura (payment reference). If in doubt, call MarcaSAT, the SAT's helpline: 55 627 22 728.

What to review and what options you have

With the genuine letter in hand, reconstruct the discrepancy it identifies and decide on the basis of documents, not in haste.

  1. Open and save the document

If it arrived through the Buzón, open it within three business days of the alert. Save the receipt and the letter; note the date, control number, and deadline.

Deadline: 3 business days after the alert

  2. Find the source of the discrepancy

Check the period against your CFDI (electronic tax invoices), accounting records, and payments. Obtain your tax compliance opinion (Article 32-D of the CFF) to rule out unfiled returns or final assessments.

  3. Clarify, if the discrepancy does not exist

Follow the channel and deadline stated in the letter. For a deep oversight invitation letter, the SAT allows ten business days from service or from the interview and accepts the clarification at the institutional email address given in the letter, at the interview, or in Mi portal. Notices of unfiled returns can be clarified in Mi portal at any time. Keep the receipt with its folio number.

Deadline: Per the letter, or 10 business days

  4. Self-correct, if the discrepancy is real

File the amended return with inflation adjustment and late-payment surcharges. Article 32 of the CFF allows a return to be amended up to three times as long as no audit has been initiated, and more times when the amendment only increases income or reduces deductions.

  5. Document the decision not to act

Not acting is also an option, but a reasoned one, in writing: what was reviewed, why the discrepancy does not apply, and what evidence supports that conclusion.

What the Supreme Court has said

In binding precedent (jurisprudencia) 2a./J. 62/2013 (10a.), the Second Chamber of the Supreme Court held that the carta invitación to regularize income tax (ISR) on cash deposits is not a final ruling that can be challenged in administrative litigation before the TFJA (Federal Court of Administrative Justice), but a declaratory act causing no actual harm to the taxpayer. In 2a./J. 110/2019 (10a.), it extended that criterion to the decision rejecting a clarification filed against the letter, as long as that decision does not determine an amount payable or establish legal consequences, warnings of sanctions, or loss of benefits.

The consequence is twofold: as long as the document is merely an invitation, with no fine, determined amount, or warning, there is no remedy to exhaust and no deadline lost by not pursuing one; but neither is there any lawsuit to stop the authority if it later reviews the same period. If what you received is a formal request with a fine or a ruling that sets a tax assessment (crédito fiscal), seek advice immediately: in that case, deadlines do run. Article 33-A of the CFF confirms that clarifications do not constitute a formal proceeding and do not interrupt deadlines. The defense is built against the subsequent act that actually defines the obligation, with the file assembled upon receiving the letter.

Frequently asked questions

Does receiving a carta invitación mean that the SAT is auditing me?

No. The carta invitación is an assistance and oversight communication based on Article 33 of the Código Fiscal de la Federación, Section IV of which provides that sending it is not deemed to initiate the exercise of audit powers. Those powers (requests for accounting records, on-site audits, desk audits) are set out in Article 42 and begin with the first act served on you within that procedure. That does not prevent the authority from exercising them later over the same period.

What happens if I do not open the letter in the Buzón Tributario?

When the letter is served through the Buzón, Article 134 of the CFF grants three business days, counted from the day after the electronic alert, to open documents pending service; if they are not opened, service is deemed made on the fourth day. That rule applies to service of notices, not to mere messages of interest, which you should read anyway. If the Buzón has not been activated or the contact methods are incorrect or outdated, Article 17-K treats the taxpayer as refusing service, and the authority may serve notice by posting (por estrados).

Can I challenge a carta invitación?

Under binding precedents 2a./J. 62/2013 and 2a./J. 110/2019 of the Second Chamber of the SCJN, the carta invitación is not a final ruling that can be challenged in administrative litigation, nor is the decision rejecting a clarification filed against it, as long as that decision does not determine an amount payable or establish legal consequences. Where a challenge is available, it is directed against the subsequent act that actually defines the obligation.

How much time do I have to respond?

The law sets no specific deadline for the carta invitación; what counts is the deadline stated in the letter itself. If it is a deep oversight invitation letter, the SAT grants ten business days to clarify or correct, from service or from the interview. Under Annex 2 of the 2026 RMF, notices of unfiled returns may be clarified at any time. If what you received is a formal request under Article 41, the deadline to comply is fifteen days; Article 33-A allows six days to clarify it, and Annex 2 accepts a clarification within fifteen. The three days to open the document in the Buzón run separately.

Who can receive a carta invitación?

Any individual or legal entity with an RFC, including foreign persons who hold an RFC because of their operations in Mexico. Regarding deep oversight invitations, the SAT specifies that a taxpayer in good standing may also receive one: it is enough for the SAT to detect an irregularity, difference, or inconsistency between what was reported and the information in its databases.
