Anyone opening a business in Playa del Carmen needs, before the operating license, a land-use certificate; for many lines of business, approval (anuencia) from Civil Protection (the municipal fire-and-safety authority); and, if a billboard will be installed, a sign license. Knowing how long each office has to respond and what to do if it remains silent helps you avoid opening without a license and avoid waiting for an answer that the law already considers given.
The essentials, in thirty seconds
- Every business must enroll in the municipal business registry and apply for its operating license within thirty days after starting operations (Municipal Revenue Law, Articles 85 and 86); operating without a license is penalized.
- Filing is online only with the Revenue Office, which states a response time of 3 to 5 business days for a complete file; the Revenue Law also requires the land-use certificate and, for higher-risk businesses, Civil Protection approval.
- If the authority does not decide in time (three months as the State Code's general rule; four before municipal tax authorities), silence amounts to a negativa ficta (deemed denial). Deemed approval applies only if a rule so provides.
- The date is proven with the stamped copy for in-person filings (Article 119) or the acknowledgment with a folio number for online filings, such as the operating license; that proof is attached to the complaint against a deemed denial.
- A denial may be challenged by the State Code appeal for review (decided by the Sindicatura, the municipal trustee's office) or, for tax acts, the Municipal Tax Code revocation appeal, and in the State Court of Administrative Justice.
Which authorizations you need and who issues them
The Ley de Hacienda del Municipio (Municipal Revenue Law) requires businesses to enroll in the municipal business registry and to apply online for the operating license within thirty days after starting operations (Articles 85 and 86). The Código Fiscal Municipal (Municipal Tax Code) penalizes late enrollment and imposes a higher fine, and even a temporary closure, for operating without first obtaining the license (Article 68, Sections I and III). The license is issued by the Revenue Office; the Urban Development Office issues land-use certificates and sign licenses, and Civil Protection issues its approval (Reglamento Orgánico, the municipal organic regulations, Articles 40, 76, and 88).
| Procedure | Office | Published response time | Validity |
|---|---|---|---|
| Operating license (online only) | Revenue Office, Treasury | 3 to 5 business days | Fiscal year |
| Land-use certificate for commercial activity | Urban Development and Urban Image | Up to 3 months; deemed denial | Indefinite, unless the business activity or the holder changes |
| Civil Protection approval (higher-risk businesses) | Civil Protection and Fire Department | Inspection; 30 calendar days to comply | Fiscal year |
| License for a sign with a structure (billboard) | Urban Development and Urban Image | Up to 3 months; deemed denial | One year |
Typical requirements and the fast track for low-risk businesses
Under Article 86 of the Revenue Law, the application must be accompanied by the tax status certificate (constancia de situación fiscal), proof of payment of property tax and waste collection fees, the alcoholic beverage license if alcohol is sold, the land-use certificate, Civil Protection authorization for higher-risk businesses, and the document entitling the applicant to occupy the premises. The official procedure sheet also requests a certificate of completion of construction, photographs, and, where applicable, payment of ZOFEMAT fees (for use of the federal beachfront zone), and does not mention the land-use certificate or Civil Protection. Since the Ley de Mejora Regulatoria (Regulatory Improvement Law) prohibits, with some exceptions, requiring items not listed in the registry (Article 50), check the official procedure sheet. For low-risk businesses, the SARE (rapid business start-up program) combines the land-use certificate, the Civil Protection approval, and the license at a single in-person window.
SARE: three business days after the payment receipts are presented
- Low-risk business under the current catalog, located within the urban area and on a lot suitable for commercial use.
- Up to 350 square meters, fewer than ten people including employees, no alcohol, and gas storage of up to 120 liters.
- Does not apply: Alcohol sales, larger premises, or medium- and high-risk businesses: standard procedure.
Response deadlines, deemed denial, and deemed approval
Unless a legal provision or a general administrative rule sets another deadline, the Código de Procedimientos y Justicia Administrativa del Estado (State Code of Administrative Procedure and Justice) gives the authority, including municipal authorities, three months to decide; once that period expires, the application is deemed denied, and a request to cure deficiencies (prevención) suspends the period (Articles 1, 23, and 24). The Code refers tax acts to their own legislation (Article 2): if the operating license is treated as a filing before a tax authority, the Municipal Tax Code sets four months, counted again from the date a formal request (requerimiento) is answered, and allows a challenge at any time while no decision is issued (Article 39). None of the procedure sheets for these filings provides for deemed approval (afirmativa ficta): the land-use and sign sheets state that a deemed denial applies, and the license sheet is silent. For these procedures, silence does not amount to a granted license.
How to prove the date of your application
Offices may not refuse to accept filings and must record receipt with a date stamp or a signed notation, including on the applicant's copy (Article 119); for filings sent by certified mail, the postmark date counts (Article 118). The operating license can only be processed online: keep the acknowledgment showing the folio number and date. If an observation sent to the registered email address is not addressed within five business days, the application is canceled (Article 89 of the Revenue Law).
- Keep proof of filing
A stamped copy or an electronic acknowledgment with a folio number. If you receive a request to cure deficiencies or a formal request, answer it on time and keep that acknowledgment as well.
Deadline: Same day
- Calculate the maximum period
Three months as the general rule; four before a municipal tax authority; or the specific period if the procedure sheet sets one. Periods expire on the same date in the corresponding month or, if that day is not a business day, on the next business day (Article 35).
Deadline: 3 or 4 months
- Request the certificate of deemed denial
The authority must issue it within two business days (Article 115); a refusal to certify it can also be challenged (Article 174, Section VI).
Deadline: 2 business days
Administrative appeals and litigation before the Court
The appeal for review (recurso de revisión) under the State Code is filed with the authority that issued the act within fifteen business days from the date service of notice of the act takes effect (Article 158); at the municipal level it is decided by the Sindicatura, the municipal trustee's office (Article 163), and it is optional (Article 155). If the act is a tax matter, such as a fine for operating without a license, the appropriate remedy is the revocation appeal (recurso de revocación) under the Municipal Tax Code, within forty-five days (Articles 94, 95, and 97; Article 2 of the State Code).
In either case, an action may be brought before the Tribunal de Justicia Administrativa y Anticorrupción del Estado (Quintana Roo State Court of Administrative Justice and Anti-Corruption), seated in Chetumal and with chambers authorized by its full bench (Organic Law, Articles 7 and 25): against express decisions, within fifteen business days (Article 194), and against a deemed denial, by attaching the copy of the application bearing the receipt stamp (Articles 174, Section IV, and 198, Section IV). The choice of procedure depends on each case file. The firm handles these matters through its Administrative Law practice.
Frequently asked questions
May I open my business while my operating license application is pending?
The Revenue Law requires businesses to enroll in the registry and apply for the license within thirty days of starting operations, and the Municipal Tax Code requires obtaining it within the next month (Article 19). That Code penalizes late enrollment with a fine of 22.92 to 343.92 times the daily value of the UMA (Unit of Measurement and Update, the index for fines; Article 68, Section I) and, separately, operating without first obtaining the license, with a fine of 22.93 to 573.20 times that value (Section III); in both cases the tax authority may order a temporary closure until the business complies. Silence is not authorization, and the filing acknowledgment does not replace the license.
If the municipality does not respond within the deadline, is the license deemed granted?
No. In Quintana Roo the general rule is deemed denial (negativa ficta): once the period to decide expires, the application is deemed denied, unless a rule expressly provides for deemed approval (afirmativa ficta) for that procedure (Articles 23 and 115 of the State Code of Administrative Procedure and Justice). None of the municipal procedure sheets for the filings described here provides for deemed approval; the land-use and sign sheets expressly state that a deemed denial arises after three months.
What does Civil Protection require to grant its approval, and what happens if my premises are in a residential zone?
The Municipal Civil Protection Regulations require compliant gas installations (with an expert report if there is a stationary tank or natural gas), an electrical report, evacuation signage, fire extinguishers and detectors according to the risk analysis, a first-aid kit, and trained staff (Article 111). For low-risk businesses in residential zones that cannot obtain commercial land use, there is a [special operating license](https://playadelcarmen.gob.mx/mpdc-tm-di-lfme-014), based on a resolution published in the Periódico Oficial (Official State Gazette) on December 24, 2024; it is processed in person and decided within five business days once the Civil Protection approval is submitted.
How do I prove when I filed my application if I did so online?
Keep the acknowledgment or folio number generated by the procedures platform and the notices received at the email address you registered, since the Revenue Law treats that address as valid for notices and for service of notice, and an observation not addressed within five business days cancels the application (Article 89). For in-person filings, ask that receipt be recorded on your copy with a date stamp or a signed notation: the Code prohibits offices from refusing to accept filings (Article 119).
Do I have to exhaust the appeal for review before going to the Court?
No. The Code allows you to file the appeal for review with the authority itself or, where applicable, to go directly to court (Article 155). The appeal must be filed within fifteen business days, and at the municipal level it is decided by the Sindicatura. If the act is a tax matter, such as a fine imposed by the Treasury, the remedy is the revocation appeal under the Municipal Tax Code, with a forty-five-day deadline (Articles 94 and 97), and litigation before the Court also remains available (Article 2 of the State Code). Which route is advisable depends on the act, the evidence, and the urgency of each case.
Are licenses issued in the name of the Municipality of Solidaridad still valid?
Yes. The change of name to Playa del Carmen (Decree 108, published on March 20, 2025, together with the amendment to the State Constitution) did not alter the nature of the municipality. Its transitional articles provide that procedures, permits, and licenses issued under the former name remain valid without any additional filing, and that every reference to Solidaridad in laws and regulations is understood to refer to Playa del Carmen.
